These terms cover use of the LumiDesk websites at lumideskai.com and lumideskai.co.uk, and — when you buy or trial it — LumiDesk Loyalty Core and related services. By using the sites or services you agree to these terms.

1. Who these terms are for
- Website visitors — anyone browsing or contacting us via the marketing sites
- Business customers — shops and operators who buy, trial or configure Loyalty Core or other LumiDesk add-ons
End customers who join a shop’s stamp card also interact with systems we run; their relationship for the loyalty scheme is primarily with that shop. Our privacy notice explains how data is handled.
2. What LumiDesk provides
Loyalty Core is an SMS stamp-card loyalty product for UK local businesses. In outline it includes:
- QR signup (first name, UK mobile, recorded SMS consent — consent starts unticked)
- Welcome and stamp-balance texts, unique reward codes, and staff phone commands (STAMP, REMOVE, REDEEM) as described on the marketing site
- Limited reactivation and review-ask messages as configured for the shop
Descriptions of staff commands and customer journeys on the site explain how the product works. Exact configuration, go-live timing and commercial terms are agreed on the walkthrough or in a separate order/confirmation — we do not publish a public tariff on the marketing page.
Optional add-ons (websites, CRM/calendars, booking/deposits, AI social content, AI receptionist and similar) are separate from Loyalty Core and quoted separately.
3. Website use
- Use the sites lawfully and honestly
- Do not attempt to disrupt, scrape abusively, or gain unauthorised access to our systems or those of our processors
- Content on the sites (copy, branding, layout) belongs to LumiDesk or its licensors and may not be copied for commercial use without permission
- Booking and enquiry widgets may be provided by third parties (for example HighLevel / LeadConnector); their availability can affect forms and diaries on the page
4. Enquiries and walkthroughs
Booking a walkthrough or sending an enquiry does not create a paid contract. Commercial terms (scope, fees, cancellation, SMS usage) are confirmed in writing or on the call before you become a paying customer. Nothing on the marketing site invents prices for Loyalty Core.
5. Business customer obligations (Loyalty Core)
If you operate Loyalty Core for your shop, you agree to:
- Use the service only for your legitimate business and in line with UK law, including UK GDPR and PECR for electronic marketing
- Ensure join-form wording, consent and STOP handling match how you actually message members
- Authorise only trusted staff numbers for STAMP, REMOVE and REDEEM commands, and keep those numbers up to date
- Provide an accurate privacy notice URL for your members where required
- Not use the service for unlawful content, harassment, spam outside the agreed loyalty programme, or misleading rewards
- Pay fees as agreed and keep contact/billing details current
You remain responsible for your relationship with your customers (rewards promised, staff behaviour, and any claims about your shop).
6. Our obligations and service level
We will provide Loyalty Core with reasonable care and skill, using reputable processors (including SMS and CRM/tooling providers such as HighLevel where relevant). We do not guarantee uninterrupted SMS delivery — carriers and handsets can delay or block messages. A staff “success” confirmation is intended only after the relevant operation has worked in our systems; it is not a guarantee of handset delivery.
We may suspend or limit access to protect security, prevent abuse, or comply with law, and will aim to notify you where practical.
7. Fees, trials and cancellation
Fees, billing cycles, included SMS volume (if any), overage and cancellation terms are those we agree with you for your account — typically discussed on the walkthrough and confirmed in writing. The marketing site may state that you can cancel anytime; the precise notice period and effect on prepaid periods will be as agreed for your plan.
On cancellation we will stop providing the service for new stamps and messages after the agreed end date, and handle member data as set out in our privacy notice and your instructions.
8. Intellectual property
LumiDesk branding, site content and software remain ours (or our licensors’). You keep ownership of your business content, logos and member lists. You grant us a licence to use that material solely to provide the service.
9. Privacy
Personal data is handled as described in our privacy notice. For Loyalty Core member data, you are typically the controller and we are the processor; a data processing arrangement can be provided on request.
10. Disclaimers
The marketing sites are provided “as is”. Example SMS threads, QR cards and command lists are illustrations of how Loyalty Core is designed to work — not a live guarantee for every shop on every day.
Nothing on the sites constitutes legal, tax or regulated advice. You should take your own advice on PECR, GDPR and consumer law for your trade.
11. Liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited under English law.
Subject to that, we are not liable for indirect or consequential loss (including loss of profit, revenue, goodwill or data), and our total liability arising from the websites or a given contract year of services is limited to the fees you paid us for those services in that year (or £100 if you are only a website visitor with no paid contract).
12. Indemnity (business customers)
You agree to indemnify us against claims arising from your misuse of the service, your messaging content, your promised rewards, or your failure to obtain required consents — except to the extent caused by our breach of these terms.
13. Changes
We may update these terms by posting a new version on this page and updating the “Last updated” date. Material changes to paid services will be notified to business customers where practical. Continued use after changes take effect constitutes acceptance, except where a separate written agreement says otherwise.
14. Governing law
These terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that we may seek injunctive relief in any jurisdiction to protect our IP or systems.
